GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") are entered into between:

Hereinafter referred to as "Mas du Roseau",

and any natural or legal person making a purchase on the Mas du Roseau website, hereinafter referred to as "the Customer".

Before placing any order, the Customer is invited to read these Terms and Conditions. Their express acceptance is mandatory to validate an order.

If the Client is a minor, he/she declares that he/she is acting with the prior authorization of his/her legal representative.


2. OBJECT

These General Terms and Conditions define the rights and obligations of the parties in the context of the online sale of products marketed by Mas du Roseau.

All orders imply unreserved acceptance of these Terms and Conditions.

Mas du Roseau reserves the right to modify these Terms and Conditions at any time. The applicable terms are those in effect at the time the order is validated.


3. PRODUCTS

The products offered for sale are those listed on the website, subject to availability.

Mas du Roseau takes great care in the presentation of its products. However, as some products are handcrafted, slight differences in color, texture, weight, or appearance may exist without constituting a defect.

The photographs, illustrations and visuals on the site are presented for illustrative purposes only and have no contractual value.

In the event of unavailability after order confirmation, the Customer will be informed as soon as possible. They will be able to choose between:

  • the reimbursement of sums paid; ;
  • or, where possible, an additional manufacturing or restocking period.

4. PRICE

Prices are shown in euros (€), including all taxes (TTC).

Delivery costs are specified before final order confirmation.

Mas du Roseau may change its prices at any time. However, products are billed based on the price in effect at the time the order is validated.

The products remain the property of Mas du Roseau until full payment of the price.


5. ORDER

The customer places their order directly on the website.

All orders imply acceptance of the prices and descriptions of the products.

Mas du Roseau reserves the right to refuse or cancel any order, particularly in the following cases:

  • of previous dispute with the Client; ;
  • of default of payment; ;
  • suspicion of fraud; ;
  • misuse of the services offered.

An order confirmation is sent by email after payment has been validated.


6. PAYMENT

Payment is made exclusively online.

The accepted payment methods are:

  • Bank card (Visa, Mastercard, CB); ;
  • Apple Pay; ;
  • PayPal.

Payment is due immediately upon ordering.

All transactions are secured using the SSL protocol and partner payment solutions.


7. DELIVERY

7.1 Deadlines

Delivery times begin from the date of effective payment validation.

They include:

  • the order preparation time (usually between one and two working days); ;
  • the delivery time specific to the selected carrier.

The stated delivery times are indicative only.

Mas du Roseau cannot be held responsible for delays attributable to the carrier or to a case of force majeure.


7.2 Delivery Area

We ship your orders in Metropolitan France, in Corsica as well as in several European countries via the network DPD Relay.

Delivery charges are applied based on the destination's geographical area. You can find details of the rates and delivery conditions on our page. Delivery conditions.

For any destination not listed, our team remains at your disposal to study your request and offer you a suitable delivery solution.

7.3 Delivery methods

The Customer can choose from:

  • delivery to a collection point; ;
  • home delivery; ;
  • in store pickup:

7.4 Home delivery requiring an appointment (Predict or equivalent service)

When the chosen delivery method requires scheduling an appointment with the carrier (particularly via the Predict service or any equivalent service), the Customer agrees to take the necessary steps to enable delivery.

In the event of failure to make an appointment, failure to keep an appointment or any other situation resulting in a penalty charged to Mas du Roseau by the carrier, Mas du Roseau reserves the right to pass this penalty on to the Client.


7.5 Uncollected or returned package

When the package is returned to Mas du Roseau due to:

  • of exceeding the collection deadline at the relay point; ;
  • from an incorrect address provided by the Client; ;
  • of repeated absence during delivery; ;
  • or any other cause attributable to the Client,

Mas du Roseau will process the refund for returned products after they have been received.

The initial shipping costs will not be refunded.

If the Customer wishes to have their order reshipped, the costs of this reshipment will be entirely at their expense.


8. ORDER RECEIPT

The Customer is required to check the apparent condition of the package and products upon receipt.

Any anomaly (damaged package, missing product, breakage, etc.) must be reported within 48 hours of receipt.


9. RIGHT OF WITHDRAWAL

In accordance with the Consumer Code, the Customer has a period of fourteen (14) days from the receipt of his order to exercise his right of withdrawal.

To be eligible for a refund, the products must be returned:

  • in their original state; ;
  • not opened; ;
  • not used; ;
  • undamaged; ;
  • accompanied by their original packaging.

The return shipping costs remain entirely the responsibility of the Customer.

The refund will be issued within a maximum of fourteen (14) days after receipt and inspection of the returned products.

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for products unsealed after delivery when they cannot be returned for reasons of hygiene or health protection. Therefore, soaps, cosmetics, and personal care products whose packaging has been opened or unsealed are neither returnable nor refundable.


10. LEGAL GUARANTEES

The products benefit from:

  • of the legal guarantee of conformity (articles L217-3 et seq. of the Consumer Code); ;
  • of the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

The Customer has a period of two years to take action under the legal guarantee of conformity.

11. RESPONSIBILITY

Mas du Roseau cannot be held responsible:

  • from misuse of the products; ;
  • from failure to comply with the precautions for use; ;
  • of a delay attributable to the carrier; ;
  • of a case of force majeure; ;
  • of an interruption of the website.

The products offered comply with French regulations. It is the Customer's responsibility to check for any applicable restrictions in their country of delivery.


12. PERSONAL DATA

The personal data collected is necessary for order processing.

Mas du Roseau processes this data in accordance with the General Data Protection Regulation (GDPR).

The Client has, in particular, the following rights:

  • access ;
  • correction ;
  • deletion; ;
  • limitation; ;
  • opposition.

13. INTELLECTUAL PROPERTY

All content on the site (texts, photographs, illustrations, graphics, logos, videos…) remains the exclusive property of Mas du Roseau.

Any reproduction, in whole or in part, without prior written authorization is prohibited.


14. MEDIATION

In accordance with Articles L611-1 et seq. of the Consumer Code, the Customer may have recourse, free of charge, to a consumer mediator with a view to the amicable resolution of a dispute.

Before contacting the mediator, the Client must have submitted a written complaint to Mas du Roseau. Mas du Roseau undertakes to acknowledge receipt of this complaint and to respond within a maximum of 14 business days from the date of receipt. If an amicable solution cannot be reached, the Client may then contact the competent mediator free of charge.

 


15. APPLICABLE LAW AND DISPUTES

These Terms and Conditions are governed by French law.

The parties will prioritize seeking an amicable solution.

In the absence of an amicable agreement, the territorially competent French courts shall have sole jurisdiction.
